Twinkle Colony

Terms and Conditions

Last updated: 27 October 2026

These conditions apply to an advisory engagement with Twinkle Colony (a retention pattern review, a role definition workshop or onboarding design support) once a written quote has been accepted. Where the quote says something different, the quote prevails.

1. The written quote

Each engagement starts with a written quote that names the service, the scope, the indicative dates, the price (including how consumption tax is treated) and when payment is due. The guide prices on the website are not an offer; they only tell you where the quote is likely to start.

2. What we do and do not do

We give strategy advice on retention, role definition and onboarding. We do not recruit, advertise vacancies, screen, refer or introduce candidates, and we do not hold or claim a licence for paid job placement or worker dispatch. We do not give legal advice on employment contracts or work rules; for those, consult a qualified professional.

3. Your part

You provide the material the work needs, such as service records and access to people for conversations, on the dates agreed. You confirm that you are entitled to share personal information with us and that the people concerned have been informed as the law requires. Delays on your side can move the dates in the quote.

4. Confidentiality

We treat what you tell us and the records you share as confidential, use them only for the engagement and do not name clients publicly. Conversations with staff are reported only as patterns. This does not apply to information that is already public or that we must disclose by law.

5. No guaranteed outcome

Our reports describe what the material shows. We do not guarantee that turnover will fall, that a position will be filled, that people will stay or that any time or cost will be saved. Decisions based on a report remain yours.

6. Payment

Fees and the timing and method of payment are agreed individually in writing before work begins. Additional work outside the quoted scope is done only after you have agreed to a further written quote.

7. Changes and cancellation

Rescheduling and cancellation, and any refund that follows, are agreed individually in writing before the engagement starts. Nothing in these conditions removes a right that you have under Japanese consumer or commercial law.

7a. Stages of an engagement

An engagement normally runs from first conversation to quote, from quote to start, through the work itself, and ends with the written report or document. Draft material shared on the way is working material and may change before the final version.

7b. Ending an engagement early

Either side may end an engagement by telling the other in writing. What has been done up to that point, and any fee for it, is settled according to the quote or, where it is silent, by agreement between us.

7c. Events beyond our control

We are not in breach where illness, disaster, interruption of transport or communications or another event outside our reasonable control delays the work; the dates in the quote move accordingly and we will tell you as soon as we can.

8. Ownership of reports

You may use the written report and role description inside your organisation as you wish. Our methods and general wording remain ours.

9. Liability

We are liable for losses we cause only to the extent Japanese law provides. Liability that cannot lawfully be limited, including for intent or gross negligence, is not limited by these conditions.

9a. Helpers and subcontractors

Twinkle Colony does the advisory work itself. If a part of an engagement were to be handled by someone else, we would tell you first and that person would be bound by the same confidentiality.

9b. Notices and language

Notices under these conditions are given by email to the addresses in the quote. The engagement is conducted in English, and the English text of the quote and of these conditions is the one that applies.

9c. The whole agreement

The written quote and these conditions together make up the agreement. Anything said earlier, on the website or in conversation, that is not repeated in the quote is not part of it.

10. Governing law

These conditions are governed by Japanese law, and any dispute is to be brought before the court that has jurisdiction under Japanese law.
